Les présentes Conditions Générales de Vente (CGV) s’appliquent à toute commande passée sur le site https://domaine-fontainebleau-en-provence.com (ci-après « le Site »), édité par :

  • La vente de bouteilles de vin et de cubis,

  • La vente de bouteilles d’huile d’olive,

  • La réservation de balades en calèche.

 

L’abus d’alcool est dangereux pour la santé, à consommer avec modération. Conformément à l’article L.3342-1 du Code de la santé publique, la vente d’alcool à des mineurs est interdite. En validant sa commande, le Client reconnaît avoir pris connaissance et accepté sans réserve les présentes CGV.

ARTICLE 1 : Company and Scope

These General Terms and Conditions of Sale (GTC) apply to any order placed on the website https://domaine-fontainebleau-en-provence.com (hereinafter “the Website”), published by:

The Company offers through its Website:

  • Sale of bottles of wine and bulk wine,

  • Sale of bottles of olive oil,

  • Booking of horse-drawn carriage rides.

 

Excessive drinking is dangerous for your health; consume in moderation. In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcohol to minors is prohibited. By validating their order, the Customer acknowledges having read and unreservedly accepted these GTC.

 

ARTICLE 2 : Produits et prestations / Products and Services

FR : Les caractéristiques principales des Produits et Prestations sont décrites sur le Site. Les photographies n’ont pas de valeur contractuelle. Les balades en calèche sont assurées par un prestataire de la Société.

EN : The main characteristics of the Products and Services are described on the Website. Photographs are non-contractual. The horse-drawn carriage rides are provided by a service provider of the Company.

 

ARTICLE 3 : Prix / Prices

FR : Les prix sont en euros TTC. Hors frais de livraison. Modification possible mais prix applicables = ceux en vigueur au moment de la commande.

EN : Prices are in euros, VAT included. Delivery costs excluded. Prices may change, but the applicable prices are those valid at the time of the order.

ARTICLE 4 : Commande / Orders

FR : Le Client sélectionne les Produits/Prestations, valide son panier, procède au paiement. Confirmation par email. La commande vaut acceptation des CGV et obligation de paiement. Vente de vin conclue sans condition de dégustation (art. 1587 Code civil).

EN : The Customer selects Products/Services, validates the cart, and proceeds to payment. Confirmation by email. The order implies acceptance of the GTC and obligation to pay. Wine sales are concluded without prior tasting (Art. 1587 French Civil Code).

 

ARTICLE 5 : Paiement / Payment

  • Carte bancaire via Stripe / Credit/debit card via Stripe + PayPal

  • Espèces, uniquement à la propriété / Cash, only for purchases made directly at the estate

ARTICLE 6 : Livraison / Delivery

FR : Livraison uniquement en France métropolitaine. Délai : maximum 15 jours ouvrés, et en tout état de cause dans un délai légal de 30 jours. Numéro de suivi communiqué. En cas d’adresse incomplète ou d’absence, frais de re-livraison à la charge du Client.

EN : Delivery only within mainland France. Maximum delivery time: 15 working days, and in any case within a legal maximum of 30 days. Tracking number provided. In case of incomplete address or absence, re-delivery costs are borne by the Customer.

ARTICLE 7 : Droit de rétractation / Right of Withdrawal

7.1 Produits / Products

FR : Délai de 14 jours après réception. Produits à retourner intacts, non ouverts, dans l’emballage d’origine. Frais de retour à la charge du Client (au coût réel). Remboursement sous 14 jours. Exception : ventes de boissons alcoolisées dont la livraison est différée >30 jours et dépend des fluctuations du marché (art. L.221-28).

EN : 14 days from receipt. Products must be returned intact, unopened, in original packaging. Return costs borne by Customer (actual cost). Refund within 14 days. Exception: sales of alcoholic beverages where delivery is deferred >30 days and value depends on market fluctuations (Art. L.221-28).

 

7.2 Prestations / Services (balades en calèche / carriage rides)

FR : Conformément à l’art. L.221-28, pas de rétractation pour les prestations de loisirs à date déterminée. Réservations non remboursables, sauf annulation par la Société.

EN : In accordance with Art. L.221-28, no withdrawal right applies to leisure services scheduled for a specific date. Bookings are non-refundable, except if cancelled by the Company.

ARTICLE 8 : Réserve de propriété / Retention of Title

FR : La Société conserve la propriété jusqu’au paiement intégral. Risques transférés à la livraison.

EN : The Company retains ownership until full payment. Risks transfer upon delivery.

ARTICLE 9 : Garanties légales / Legal Warranties

FR : Produits soumis à la garantie légale de conformité (L.217-4 à L.217-14 Code conso) et à la garantie des vices cachés (1641 à 1649 Code civil).

EN : Products are subject to the legal warranty of conformity (Arts. L.217-4 to L.217-14 French Consumer Code) and the warranty against hidden defects (Arts. 1641 to 1649 French Civil Code).

 

ARTICLE 10 : Données personnelles / Personal Data

FR : Les données personnelles sont collectées pour traiter les commandes. Politique de confidentialité disponible sur le Site.

EN : Personal data is collected to process orders. Privacy Policy available on the Website.

ARTICLE 12 : Médiation et litiges / Mediation and Disputes

FR : Le Client peut saisir gratuitement le médiateur du e-commerce de la FEVAD (www.mediateurfevad.fr) après réclamation écrite préalable à la Société. En l’absence de solution amiable, compétence des juridictions françaises.

EN : The Customer may refer the matter free of charge to the FEVAD e-commerce mediator (www.mediateurfevad.fr) after first submitting a written complaint to the Company. If no amicable solution is found, jurisdiction lies with the French courts.

ARTICLE 13 : Loi applicable et version / Applicable Law and Version

FR : Les présentes CGV sont régies par le droit français. En cas de divergence d’interprétation, la version française prévaut. Les CGV applicables sont celles en vigueur à la date de la commande.

EN : These GTC are governed by French law. In case of interpretation issues, the French version prevails. The applicable GTC are those in force on the date of the order.​
